By commissioning an avatar from me, you hereby agree to my ToS.
Breaking my ToS can result in a blacklist from any art and/or avatar comissions from me.
Please read before contacting me.This contract applies to the artist - further called seller, and person of institution- further called customer.
By ordering a custom avatar from the seller, the customer agrees to the following terms and conditionsPAYMENTS
1. Customer agrees to pay half of the full commission price for any order through PayPal or Kofi tips.2. Customer must pay the remaining commission cost upon completion of the avatar. No files will be sent to the customer until the final payment has been sent.3. Any other payment schedule must be mutually agreed upon by both the customer and seller before work on the Product commences.PRODUCT DELIVERY
4. Customer will receive all files via Discord messages, and/or via email if requested by customer.5. Any other method of delivery must be mutually agreed upon by Customer and seller.6. In the unlikely scenario the product is lost by the customer after the commission has ben fulfilled, the customer is permitted to request the files again from the seller. The seller is NOT to be held accountable for any loss of the product, and is not responsible for keeping the product incase it is lost.REVISIONS
7. The customer is entitled to request progress from the customer after 1 week of the seller confirming that work has commenced on the product. During these requests, the customer is permitted to ask for reasonable changes, provided the seller is able to make these changes at the time of modelling.7b. The changes the seller deems reasonable are: proportion adjustments to better suit customer preferences, slight colour adjustments, physbone adjustments, etc. If a change is deemed "complex", the seller is entitled to charge a small extra fee, ie. Remodeling hands, remodeling the head.CURRENCY CONVERSIONS
8. Customer agrees to pay the total amount specified, including possible extra fees, in GBP.9. It is the sole responsibility of the customer to bear any currency conversion costs, (unlikely) bank transfer fees and any other costs involved in transferring funds to the seller,REFUND POLICY
10.Customer has the right to request a full refund if there has been no confirmation of the commission being started for 2 consecutive months with no updates from the seller as the when the commission will be started. The seller will most likely have prior comissions to work on, and will update trello on all commissions.10b. Note from seller: avatar work takes a while, I usually can make an avatar within 1-2 weeks, but can take up to 3-4 weeks, rarely longer, to complete ONE avatar. If you commission me, I will be letting you know if there is a wait to expect or not, and will update you whenever I can and/or can't work on your avatar. This is not something required of me to do, so please do not pester me for updates.11. The customer is obliged to to contact the seller in a fast and responsive manner, responding swiftly to any requests for comments, clarifications, validation of progress, etc. Lack of timely communication will be recognised as implicit approval of all work progress and current state of product. (note: I understand stuff comes up and life happens, aslong as jts within PREFERABLY 12 hours, you're fine :) )PERSONAL AND COMMERCIAL USE
12. The product received by the customer is for personal use. The avatar made the seller is for the customers use only. The customer is to not make the avatar public unless a mutual agreement has been made between the seller and customer beforehand, including a possible commercial fee if the seller requests it.13. The customer is permitted to use assets from the commissioned avatar on personal use avatar WITH credit. Any public avatars found with assets from the commissioned avatar will be deemed an avatar containing ripped asset and will be either charged a commercial use fee or blacklisted from commissioning avatars from the seller.CANCELLATIONS
14. The seller reserves every right to refuse or cancel any order, under condition of a full refund, without giving reasons to the customer.15. Any disrespectful behaviour will not be tolerated and may result in a cancellation of the order. The customer will reci3ve either a full or partial refund depending on the amount of work completed. The seller will have every right to refuse any service to the customer in the future.16. The seller has every right to refuse service to any member of the VRChat community that has been found to be involved with any allegations (Ie. Pedophilia, grooming, etc.) or has been known to rip personal / pay to use avatars and involved within the avatar ripper community. The seller does not support avatar ripping, pedophilia, grooming, transphobia, homophobia, racism, ableism, sexism, ai usage, etc. and reserves the right to refuse service.
